The FTC Charges A Battery Company For Violation of Made In USA Labeling Law 15 .U.S.C 45a.
A Battery Maker Used Made In USA Stickers On Foreign Batteries. The FTC alleges that Lithionics Battery LLC been labeling batteries made in China, as Made In America. Which is now illegal under the new Made In USA Labeling law, 15 U.S.C. 45a. This new made In USA Labeling law went into effect August 13, 2021. Using Made In USA stickers on products not made in America also violates Section 5 of FTC law. Section 5 of the Federal Trade Commission Act (FTC Act) (15 USC 45) prohibits ‘‘unfair or deceptive acts or practices in or affecting commerce.’’
No marketer is allowed to advertise with Made In USA stickers unless all or virtually all parts or ingredients are made and sourced in The United States, Along with the final assembly/ processing being completed inside America.
Made In USA Stickers On Foreign Products
“As our country works to onshore production of lithium-ion batteries, it’s critical that honest businesses have a chance to compete, and that consumers can buy American,” said Sam Levine, Director of the FTC’s Bureau of Consumer Protection. “Falsely labeling batteries as made in the United States is against the law, and the FTC is using its new Made in USA rule to make sure this misconduct comes with a price.”
Lithionics sells battery products for cars, boats and other vehicles. The battery manufacturer used Made In USA stickers and sometimes added the phrase "proudly designed and built in USA".
General Manager Steven Tartaglia of Lithionics Battery LLC was featured in a Youtube company video showing employees adding Made In USA stickers to batteries. And adding American flag images to convey the batteries, battery module, and battery management products were made in USA.
But according to the FTC Lithionic batteries and modules were produced with Chinese made lithium ion cells.
The battery manufacturer also doubled down on the Made In USA claims in mail order catalogs, and social media. The complaint cites YouTube videos featuring Tartaglia and company employees putting Made in USA labels on Lithionics products. Other marketing materials had a chart comparing the “advantage[s] of Lithionics battery systems” being compared to other “imports.”
Tartaglia and Lithionics must pay civil penalties of over $100,000, equal to three times Lithionics’ profits attributable to the illegal activity.
